In India, the Surrogacy (Regulation) Act, 2021, regulates the practice and process of surrogacy and constitutes the National Assisted Reproductive Technology and Surrogacy Board and the State Assisted Reproductive Technology. This Act prohibits commercial surrogacy; however, it allows altruistic surrogacy with no monetary compensation to the surrogate mother except the medical expenses and insurance coverage during pregnancy. Every surrogacy clinic is required to register under this Act, and every procedure requires submission of the appropriate application form within the stipulated period, along with the prescribed fee.
